Dear Oneida County Attorney Peter M. Rayhill:

Inclosed please find a list of properties acquired by MVHS for the specified sum of monies. We would like to inquire from you as to whether the amounts paid by MVHS are accurate.

Since Oneida County is taking over responsibilities for the proposed MVHS Parking garage, we trust that the amount of money to be paid for the remaining properties by Oneida County will be at a comparable market value including any existing tenant value.

Information regarding property sales and purchased by MVHS we received are as follows:

-RCIL $2,250,00.00

-Clemente $1,750,00.00

-Mohawk Hospital Equipment $1,480,00.00

-Thorpe Holdings $750,000

-Salvation Army $725,000

-Maurgeri’s-$700,000 (offered)

-Brandeles, HJ $550,000

-CP Read $540,000

-Springer Smaltz $445,000

-Teasers $395,000

-ABC Chemdry $350,000

-Fisher Auto $210,000

-Zandro $210,000

-Metzger Printing $155,000

-Polanco $145,000

How did MVHS ascertain these figures for the listed properties? Were there appraisals done for each of the properties listed? Would you have the recorded figures for Wilcor International? We’ve contacted Oneida County Deeds department and Wilcor International has not been recorded.

It’s our understanding Oneida County cannot use Eminent Domain for private purpose. In this case, MVHS which will be using the proposed garage for an estimated 1140 parking spaces according the the editorial in the Utica OD along with another 1000 plus parking spaces in the surrounding area. Eminent Domain law is only used for public purpose not for a private corporation who will benefit. Is there a Case Law pertaining to this topic?. Also, is there a sketch for the proposed MVHS parking garage? We would like to know what properties are necessary to be acquired to build a proposed parking garage for MVHS.

What is the timeframe for the clean-up for the proposed MVHS parking garage, specifically on the empty lot across the street from Salvation Army owned by National Grid? It’s our understanding this vacant parcel is contaminated.

Your attention to our concerns are greatly appreciated.

Respectfully,
Dan Walker
